- Parties. This Agreement (“Agreement”) was concluded between Elman Mussa Designs Endustriyel Tasarim Ltd (hereinafter referred to as “LIGHTSOLID”), owner of the website www.lightsolid.net, located at 175 Buyukdere cd, Ferko, ic kapi 7, 34394, Sisli, Istanbul and the internet user (“MEMBER”) who is a member of the www.lightsolid.net website on {date}.
- Subject of the Agreement. The Subject of the Agreement is to determine the conditions for MEMBER to benefit and use the website www.lightsolid.net owned by LIGHTSOLID.
- Rights and Obligations of the Parties.
3.1. MEMBER accepts and undertakes to comply with all legal regulations and not to violate such provisions while using the www.ightsolid.net website. Otherwise, the MEMBER will be fully and exclusively responsible for all legal and criminal liabilities that may arise.
3.2. MEMBER cannot engage in activities (launching spam, viruses, trojan horses, etc.) or transactions that prevent or make difficult for others to use the services on the www.lightsolid.net website.
3.3. MEMBER cannot use the www.lightsolid.net website in any way that disrupts public order, is contrary to general morality, disturbs or harasses others, violates the intellectual and copyright rights of others, or for any illegal purpose.
3.4. The ideas and thoughts declared and written and the expressions used by MEMBERS on the www.lıghtsolid.net website are exclusively the MEMBERS’ own personal ideas and comments, and only the MEMBER is responsible for the consequences of these ideas and comments. These views and opinions have no relation or connection with LIGHTSOLID. LIGHTSOLID has no liability for any damages that third parties or institutions may incur due to the ideas and opinions expressed by the MEMBER, or for any damages that the MEMBER may incur due to the ideas and opinions declared by third parties or institutions.
3.5. MEMBER declares and undertakes that the personal and other information he provides while becoming a MEMBER to the www.lightsolid.net website is truthful and that he will compensate LIGHTSOLID in full and in cash for any damages it may incur due to the untruth of this information.
3.6. The MEMBER’s exclusive right to use the password obtained from the LIGHTSOLID website belongs to the MEMBER. MEMBER cannot give this password to any third party. All legal and criminal liability regarding the use of the password belongs to the MEMBER.
3.7. LIGHTSOLID will not be held responsible for any unauthorized access to MEMBER data or any damage that may occur to MEMBER software and data. MEMBER has agreed in advance not to claim compensation from LIGHTSOLID for any damage he may incur due to the use of the www.lightsolid.net website.
3.8. MEMBER has agreed not to access or use the information and software of other internet users without permission. Otherwise, the legal and criminal liability arising therefrom belongs entirely to the MEMBER.
3.9. The MEMBER who violates one or more of the articles listed in this Agreement accepts and undertakes that he will be responsible for all damages that may arise as a result and will keep LIGHTSOLID free from all damages, lawsuits, demands and claims that may arise for this reason and will indemnify them against them.
3.10. LIGHTSOLID has the right to unilaterally suspend or terminate the MEMBERSHIP of the MEMBER at any time and delete all data, documents and files belonging to the MEMBER without assuming any liability.
3.11. All intellectual property rights regarding the design and software of the www.lightsolid.net website and the text and visual content of the products are the property of LIGHTSOLID, and these cannot be used by the MEMBER without the written permission of LIGHTSOLID.
3.12. The name and Internet Protocol (IP) address of the Internet service provider used by LIGHTSOLID for the improvement and development of the www.lightsolid.net website and/or to access the site within the framework of legal regulations, the date and time the site was accessed, the pages accessed while on the site and the direct access to the site. Some information, such as the Internet address of the website that allows you to connect, may be collected.
3.13. LIGHTSOLID can send letters, e-mails, SMS, telephone calls and other communications via the address, e-mail address, fixed and mobile phone lines and other contact information written by the MEMBER in the registration form on the site or mobile application or updated by him later. LIGHTSOLID has the right to reach the user for communication, marketing, advertising, promotion, notification and other purposes. By accepting this agreement, MEMBER accepts and declares that LIGHTSOLID may engage in the above-mentioned communication activities, unless there is a written notification to the contrary.
3.14. MEMBER declares and accepts that he/she allows information and announcements to be sent to him/her about product and service promotions, advertisements, campaigns, advantages, surveys and other customer satisfaction practices of ELMAN MUSSA DESIGNS ENDUSTRIYEL TASARIM LTD brands within the scope of the practices in force and/or to be put into effect. MEMBER declares and accepts that he/she consents to the collection, use and archiving by LIGHTSOLID of the personal and shopping information and shopping and/or consumer behavior information he/she has provided in the past and/or will provide in the future while becoming a member of LIGHTSOLID and/or through other means, for the above purposes. MEMBER declares and accepts that he/she consents to the collection, use and archiving of data by LIGHTSOLID, even after his MEMBERSHIP terminates, unless he states otherwise. MEMBER accepts and declares that he will not claim any direct and/or indirect material and/or moral, negative and/or positive, in short, any damage due to the collection, sharing, use, archiving and access of the above-mentioned information and will not hold LIGHTSOLID responsible. If MEMBER wishes to change his data sharing preferences, he can forward this request to LIGHTSOLID’s customer service call centers.
3.15. LIGHTSOLID may disclose MEMBER’s personal information (a) in case it is required to disclose the personal information in accordance with the applicable laws or regulations or a court decision or administrative order and (b) may disclose it to third parties in the cases specified in the article 3.13 and (c) upon MEMBER’s consent.
3.16. Precautions have been taken within available means to ensure that the LIGHTSOLID website is free of viruses and similar software. In addition, in order to ensure ultimate security, the user must supply his own virus protection system and provide the necessary protection. In this context, by entering the LIGHTSOLID website, the MEMBER is deemed to have accepted that he/she is responsible for all errors that may occur in his/her software and operating systems and their direct or indirect consequences.
3.17. LIGHTSOLID has the right to change the content, design and software of the site at any time, to change, suspend or terminate any service provided to users and to delete user information and data registered on the website at any time.
3.18. LIGHTSOLID may update, change or repeal the terms of this Agreement at any time without the need for prior notice and/or warning in any way. Each updated, changed or repealed provision will be valid for all MEMBERS on the date of publication.
3.19. In accordance with this Agreement, LIGHTSOLID is authorized to send informational e-mails to its MEMBERS’ registered e-mail addresses and informative SMS to their mobile phones. By approving this Agreement, the MEMBER will be deemed to have consented to the sending of informational e-mails to his e-mail address and informative SMS to his mobile phone. If MEMBER wishes to give up receiving e-mails and/or SMS, he/she can cancel e-mail and/or SMS sending by submitting this request to LIGHTSOLID Customer Services. The provisions of the article 3.13. are reserved.
- Termination of Agreement. Each party may terminate this Agreement at any time by unilateral notice to the other party.
This agreement will remain in effect until the MEMBER cancels his membership or his membership is canceled by LIGHTSOLID. LIGHTSOLID may unilaterally terminate the contract by canceling the MEMBERSHIP of the MEMBER if the MEMBER violates any provision of the membership agreement.
- Settlement of Disputes. European Courts and Enforcement Offices are authorized to resolve all disputes related to or arising from this Agreement.
- Effectiveness MEMBER’s registration as a MEMBER takes place when the MEMBER reads and accepts all articles contained in this Agreement. This Agreement has been concluded and entered into force at the time the MEMBER becomes a MEMBER.
